These Terms & Conditions ("Terms") govern your use of the Forged AI website and your participation in our communications programs, including text messaging. By using this website or opting in to our messages, you agree to these Terms. If you do not agree, please do not use the site.
1. Who We Are
Forged AI LLC ("Forged AI," "we," "us," or "our") is a studio that designs and builds automations, websites, applications, and AI tooling for small businesses and enterprises. Information on this website is provided for general purposes and does not constitute a binding offer; specific engagements are governed by a separate proposal, statement of work, or services agreement.
2. SMS / Text Messaging Program Terms
Forged AI offers conversational and informational text messaging — for example, replies to inquiries, consultation scheduling, reminders, and project updates. By providing your mobile number and opting in (via a form, in writing, or by texting us first), you consent to receive such messages from Forged AI LLC at the number you provided, including messages sent using automated technology.
- Consent is not a condition of purchase of any goods or services.
- Message frequency varies based on your interaction with us; recurring messages may be sent as part of an ongoing conversation or engagement.
- Message and data rates may apply according to your mobile carrier plan.
- Opt out: reply STOP to any message to cancel. You will receive one final message confirming your opt-out, after which no further messages will be sent unless you re-subscribe.
- Help: reply HELP to any message, or contact hello@forgedai.com.
- Supported carriers: major U.S. carriers are supported. Carriers are not liable for delayed or undelivered messages.
- Eligibility: the program is intended for users in the United States who are 18 or older (or the age of majority in their state) and are the account holder or have authorization for the mobile number provided.
- Number changes: you agree to notify us before changing or releasing a mobile number you have opted in with, so we do not message its next holder in error.
Our handling of the information collected in connection with text messaging — including the commitment that mobile opt-in data and consent are never shared with or sold to third parties — is described in our Privacy Policy.
3. Client Engagements
Paid work is governed by the proposal, statement of work, or services agreement signed for that engagement. In case of conflict between these Terms and a signed agreement, the signed agreement controls. Unless that agreement says otherwise, clients own the deliverables we build for them — code, accounts, data, and documentation — upon full payment.
4. Intellectual Property
The Forged AI name, logo, website design, and website content are our property and are protected by applicable intellectual-property laws. You may not copy, imitate, or use them without our prior written permission, except as permitted for personal, non-commercial viewing of the site.
5. Acceptable Use
You agree not to misuse the website — including attempting to disrupt it, probe or breach its security, scrape it at abusive volumes, or use it for unlawful purposes.
6. Disclaimers
The website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.
7. Limitation of Liability
To the maximum extent permitted by law, Forged AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the website or messaging programs. Our total liability for any claim relating to the website or messaging programs will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold Forged AI harmless from claims arising out of your violation of these Terms or misuse of the website or messaging programs.
9. Governing Law
These Terms are governed by the laws of the United States and the state in which Forged AI LLC is organized, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in that state, and you consent to their jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent version; continued use of the website or messaging programs after changes take effect constitutes acceptance of the updated Terms.
